Terms of Use

Last updated: October 2026

This English version is provided for convenience only. The German version is the legally binding one.

1. Scope and provider

These terms of use apply to the use of stoppmichnicht, i.e. the web app at app.stoppmichnicht.de and the apps for iPhone, iPad, Android and Mac (together "the service"). The provider is Carsten Fregin, spielgestalt, Pracherdamm 106, 25436 Tornesch, Germany ("we", contact details see imprint).

stoppmichnicht is mainly intended for businesses, freelancers and their teams but is also open to consumers. Users' own terms do not apply, even if we do not expressly object to them.

If you obtain an app from Apple's App Store or Google Play, the respective store's terms for using apps apply in addition (for Apple, the "Licensed Application End User License Agreement"). As between you and us, these terms of use take precedence.

2. Services

stoppmichnicht is time tracking for teams. In particular, you can track time with a timer or by hand, manage clients, projects and tasks, work together in a team with roles (owner, admin, manager, member), create invoices with an embedded e-invoice from tracked time (section 7) and, with the add-on module "Automatic time tracking" (section 3), have time tracked automatically via an interface. The current range of features is shown in the service itself.

We continuously develop stoppmichnicht and may add, change or remove features insofar as this is reasonable for you. We announce significant restrictions at least 30 days in advance by email or in the service.

3. Plans, trial and payment

Solo is free: one member per team, up to 3 active (non-archived) projects and up to 3 invoices per calendar month. There is no automatic switch to a paid plan.

Team costs €7 per member per month with monthly payment or €72 per member per year with yearly payment, in each case plus VAT; for consumers this is €8.33 and €85.68 respectively, including 19% VAT. We bill the number of members of the team; invitations only count once they have been accepted. If members join or leave during a billing period, the difference is prorated with the next charge. The Team plan has no limits on projects and invoices.

Trial: Each team can try the Team plan once for 30 days free of charge. Owners or admins start the trial in the web app with "Try for free"; no payment method is needed and no payment obligation arises. The trial ends automatically and free of charge after 30 days. If the Team plan is not booked by then (see "Booking"), the team is moved to the Solo plan or, if it has several members, becomes read-only (see "Read-only").

Booking: The Team plan is booked and managed in the web app; the apps only show the status. The presentation of the plans is not yet an offer. On the order page you choose the billing interval and enter your billing address, your VAT ID if applicable, and a payment method. Directly before concluding the contract you see a summary (service, number of members, net and gross price, billing interval, date of the first charge, term and cancellation) and can still correct all details. By clicking "Order with obligation to pay" you make a binding offer; we accept it by activating the Team plan immediately. If you order during a running trial, the first charge takes place at its end. Immediately afterwards you receive a contract confirmation by email with the contract details, these terms and the withdrawal notice. We do not otherwise store the contract text for you to retrieve. The contract language is German.

Payment: Booking creates a subscription for an indefinite period that renews for the chosen billing period (month or year) until it is cancelled. Fees are due at the start of each billing period. Payment is handled by our payment service provider Stripe (credit card, also via Apple Pay or Google Pay, SEPA direct debit or PayPal; section 13). We provide invoices for the subscription electronically and send them by email to the address on file. Payers established in other EU member states with a valid VAT ID are billed without German VAT (reverse charge).

Add-on module "Automatic time tracking": Owners and admins of a team on the Team plan (including during the trial) can book the module "Automatic time tracking" in the web app: API keys and an interface through which programs (such as development tools) track time for a project automatically. It costs €5 per team per month or €50 per team per year plus VAT; for consumers €5.95 or €59.50 including 19% VAT, in the billing interval of the Team plan. Booking works like the Team plan via a summary and the click on "Order with obligation to pay"; we accept the offer by activating the module immediately and confirm the contract by email. The current billing period is charged pro rata immediately; during the free trial the module is free and ends with the trial unless the Team plan is ordered. You can cancel the module at any time in the web app; it then ends immediately and the fee for the rest of the billing period is credited on your next invoice. The module also ends with the Team plan.

Cancelling the subscription: You can cancel the subscription at any time with effect from the end of the current billing period: in the web app ("Manage subscription") or without signing in via the "Cancel contracts here" button (app.stoppmichnicht.de/cancel, also at the bottom of stoppmichnicht.de). We confirm receipt of the cancellation by email immediately. The Team plan remains active until the end of the period. We do not refund fees already paid for the current period unless we terminate (section 12) or are legally obliged to; the right of withdrawal remains unaffected.

Late payment: If a payment fails, we inform you by email and retry the charge in the following weeks. If payment is still not made, the subscription ends and the team becomes read-only. Further statutory rights, in particular to default interest and reimbursement of chargeback costs, remain unaffected.

Read-only: A team with several members that has neither an active Team plan nor a running trial can no longer create or change data. All content is preserved and can still be viewed and exported (reports, CSV, PDF invoices); members can be removed. Once the Team plan is booked or only one member remains in the team, everything can be edited again.

Price changes: We may change prices and the limits of the Solo plan with at least 30 days' notice by email to your account's address and in the service. Price increases apply to a running subscription only from the next billing period after the notice period and only if you agree; if you do not agree, the subscription ends with the current period. Rights already acquired for the current period remain unaffected.

Right of withdrawal for consumers: If you are a consumer, you can withdraw from the booking of the Team plan within 14 days in accordance with the withdrawal notice. Because the Team plan is activated immediately, when ordering you expressly request that we begin the service before the withdrawal period expires; if you withdraw, you pay a proportionate amount for the time until the withdrawal.

4. Account and minimum age

You need an account to use the service. Your details must be accurate; when registering with an email address, you confirm it via the link we send you. Each account is personal and must not be shared with others. Keep your credentials secret and let us know if you suspect misuse of your account.

stoppmichnicht may only be used from the age of 18.

5. Teams, roles and data processing

Whoever creates a team becomes its owner. If you create a team for a company or another organisation, you confirm that you are authorised to do so; the team then belongs to that organisation, which is the customer within the meaning of these terms.

By creating a team, the owner concludes, on behalf of the team, the data processing agreement under Art. 28 GDPR (German only) in the version current at that time. The team is the controller for the data it processes in stoppmichnicht (in particular its members' time entries and the data of its clients' contact persons). In particular, it ensures that

stoppmichnicht is a tool for tracking project and working time. Whether it meets statutory obligations to record working time (e.g. under the German Working Hours Act) in an individual case is for the team to check.

6. Acceptable use

You may only use the service in accordance with applicable law and these terms. In particular, you must not

In case of a violation, we may block content and temporarily block accounts or teams or terminate under section 12. We take your legitimate interests into account and inform you where possible.

7. Invoicing and e-invoices

Owners and admins can create invoices from tracked time in stoppmichnicht. We only provide the tool; the issuer of the invoice is the team. The team itself is responsible for

The invoice PDFs contain an e-invoice in ZUGFeRD or Factur-X format (EN 16931 profile). We create them with care according to the published specifications but do not warrant that every recipient will accept them or that they meet particular requirements of individual recipients (e.g. XRechnung for public authorities). stoppmichnicht does not provide tax or legal advice; if in doubt, consult your tax advisor.

8. Your content

The content that you or your team enter in stoppmichnicht remains yours or the team's. You grant us only the rights we need to provide the service to you (e.g. storing it, displaying it to authorised members, generating invoice PDFs). We do not analyse your content for our own purposes and do not sell it.

9. Availability

We operate the service with due care, but there is no entitlement to constant availability. Maintenance, disruptions at service providers (in particular Google Firebase and Google Cloud) or security measures may temporarily restrict the service. A running timer measures time using your device's clock; check your time entries before billing.

10. Backups and handing over data

We store your data redundantly with Google Cloud in the EU. You are responsible for backing up data you need permanently, in particular invoices. Owners and admins can export the team's data themselves at any time in the team settings ("Export team": JSON, CSV and the invoice PDFs as a ZIP file); everyone can export their account data and the time they tracked in the settings. On request, we also provide the owner of a team with the team's data in a common, machine-readable format (e.g. JSON or CSV) together with the invoice PDFs.

11. Liability

We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee we have given. In cases of simple negligence, we are only liable for breach of an essential contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely; in this case, liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability is excluded. These rules also apply to our vicarious agents. Liability under Art. 82 GDPR remains unaffected.

12. Term, termination and account deletion

The user agreement runs for an indefinite period. You can terminate it at any time without notice by deleting your account in the settings or by asking us by email to stoppmichnicht@spielgestalt.de to delete it. If you are the owner of a team with other members, transfer the team to another member or delete it first.

Deleting a team: The owner can delete a team in the team settings ("Delete team"). All members lose access immediately and are informed by email; a Team plan subscription ends immediately, and fees already paid for the current period are not refunded. The team's data is deleted permanently after 30 days; until then, the owner can ask us by email to stoppmichnicht@spielgestalt.de to restore the team or to hand over its data. If the owner chooses "Delete permanently right away", the data is deleted immediately and cannot be restored.

We may terminate the agreement with 30 days' notice, for example if we discontinue the service. A running Team plan subscription then ends with the agreement; fees already paid for the time after that are refunded pro rata. The right of both parties to terminate for good cause, in particular for serious or repeated violations of section 6, remains unaffected. You cancel the Team plan subscription under section 3; your account and the team then continue on the Solo plan or read-only.

What happens to the data after termination is governed by the privacy policy and the data processing agreement. Download or export invoices and other data you want to keep beforehand (section 10).

13. Data protection

How we process personal data is explained in the privacy policy. The data processing agreement also applies to the content of a team; it takes precedence over these terms in matters of data protection.

14. Changes to these terms

We may change these terms if the service, the law or case law changes. We will notify you of changes at least 30 days before they take effect by email or in the service. Significant changes, in particular changes to your disadvantage, only apply once you have agreed to them; if you do not agree, either party may terminate the agreement under section 12.

15. Applicable law, place of jurisdiction, language

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of the country of your habitual residence remain unaffected. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is our registered place of business. The contract language is German; an English translation is for information only.

Should any provision of these terms be invalid, the remaining provisions remain valid.
